Hurt at Work in Wilkes-Barre? You May Have More Than a Workers' Compensation Claim

Getting hurt at work can turn life upside down. One minute you are on the job, and the next you are dealing with doctor appointments, time away from work, and a lot of unanswered questions about what happens next.

Many people assume every workplace accident is simply a workers’ compensation case. That is not always true. A crash in a company vehicle, an accident on a construction site, a piece of defective equipment, or dangerous conditions on someone else’s property can sometimes involve another person or company besides the employer.

If you were injured in a workplace accident in Wilkes-Barre, it is worth finding out whether there is more to the case than workers’ compensation benefits alone. Call The Belt Law Firm, P.C. at (570) 714-3343 for a free consultation. Take the initial step toward the justice and support you deserve. Hablamos Español. Llámenos hoy.

What Types of Workplace Accidents May Involve More Than a Workers' Compensation Claim?

Workplace accidents happen in many different ways and across virtually every industry in the Wilkes-Barre area. While some incidents involve only an employer and a workers’ compensation claim, others raise questions about whether another company, contractor, property owner, or equipment manufacturer may also share responsibility for what happened.

The following workplace accidents can involve legal issues that are not always limited to a workers’ compensation claim.

  • Slip and Falls – Occur due to wet floors, cluttered walkways, or falls from elevated surfaces.
  • Machinery Accidents – Resulting from faulty or improperly maintained equipment.
  • Construction Injuries – Including falls, scaffolding failures, and heavy machinery accidents.
  • Industrial Explosions – Fires or explosions in refineries and manufacturing plants leading to severe injuries.
  • Toxic Exposure – Health issues stemming from prolonged contact with hazardous chemicals, including asbestos.
  • Electrical Injuries – Resulting from exposed wiring or unsafe electrical environments.
  • Work-Related Vehicle Accidents – Injuries sustained while operating or riding in work vehicles.
  • Repetitive Motion Injuries – Conditions like carpal tunnel syndrome due to repetitive tasks or overuse.
  • Workplace Violence – Injuries caused by physical altercations or attacks on the job.

The way an accident happened can sometimes matter just as much as the injury itself. Construction accidents, work vehicle crashes, equipment failures, and dangerous property conditions may raise questions about whether another person or company contributed to what happened.

If you were hurt in a workplace accident in Wilkes-Barre, it may be worth taking a closer look at how the accident happened and who may have been involved. Call The Belt Law Firm, P.C., at (570) 714-3343, and get your free case review today!

When a Workplace Accident May Involve More Than Workers' Compensation Benefits

The details of a workplace accident can change the entire analysis. An unsafe jobsite condition, equipment that fails unexpectedly, or a crash involving another company can raise issues that extend beyond a workers’ compensation claim.

Third-Party Negligence

A person can get hurt at work and still end up with a case that involves more than an employer and a workers’ compensation claim.

A delivery driver backs into a worker in a loading area. A subcontractor leaves equipment where it should not be. A property owner ignores a dangerous condition that has been there for weeks. The injury happened at work, but the events leading up to it may involve another person or company besides the employer.

When Equipment Fails on the Job

Equipment that has been used without incident for months or years can suddenly become part of a serious workplace accident. When that happens, attention often shifts from what the worker was doing to why the equipment failed in the first place.

Employers Without Workers' Compensation Insurance

Most people never think to ask whether their employer has workers’ compensation coverage until something goes wrong.

An employee gets hurt, reports the injury, and suddenly learns there is a problem with the insurance. The coverage may have lapsed. The business may not have obtained the proper policy. Questions that never seemed important before the accident suddenly become very important afterward.

When coverage issues surface after a workplace accident, the situation can quickly become more complicated than most people expect.

On a professional level- Mr Belt was honest, answered all my questions and I knew what to expect. Very knowledgeable about the law. On a personal level- I hadn’t slept the night before the case and I had a bit of anxiety beforehand. Mr. Belt sat in the seating area with me and talked about coffee places. I was cool as a cucumber when it was time to go in. Bottom line is… I’d put all my trust in Mr. Belt and you could too. Also, the women that worked in the front office were always very kind on the phone and in person.

After extensive research, I decided to hire Timothy Belt as my workers’ compensation lawyer based on favorable reviews. Unfortunately, this decision proved to be a serious mistake. I anticipated that he would offer proper guidance and maintain effective communication, which are crucial responsibilities of a lawyer. His deficiency to do so resulted in significant financial strain and emotional distress. Due to his lack of effort and poor performance in my case, the best decision was to terminate his services and seek a new counsel. The difference was extremely noticeable and resulted in a fair outcome.

I just met with Timothy today. (Eric A.) He was very kind, very very knowledgeable about my unique circumstance and I decided to not continue my case in filing an appeal. He had a check in hand for close to a grand, I offered to pay him for his time as it seemed a bad decision to continue my unemployment claim with his knowledge on the subject, although he certainly would have. There were many hurdles, mostly my fault. I would have only ended up with a couple hundred bucks if we won. He was very very clear about that. I offered to pay him for his time today and for emails back and forth, and he just said, we 'll consider this a consultation at no charge. I can't guarantee that to everyone. But he continued to hear my plight after that and said he felt bad for the position I was in. Even gave his thoughts on the matter. Having had to work with many law firms over my years here on earth, I was very impressed with his knowledge and willing to do what he could to help. Thank you Timothy Belt! Much appreciated.

In most cases you have up to three years from the date of injury to file a Claim Petition.
