Wilkes-Barre Unemployment Lawyer

Wilkes-Barre Unemployment Lawyer

Losing a job is stressful enough without having to figure out Pennsylvania’s unemployment system on your own. The rules are strict, the deadlines are short, and a small mistake can mean weeks or months without benefits. In many cases, the problem isn’t whether you’re entitled to benefits, it’s how your situation was explained to the state or how your employer described your separation. If you live or work in the Wilkes-Barre area and are facing a denial, a contested claim, or a hearing, having someone who knows the system can make a real difference.

Whether you are filing for the first time or challenging a decision that doesn’t match what really happened, The Belt Law Firm, P.C., can guide you through each step. Call (570) 714-3343 to speak with an unemployment lawyer who knows the system and knows how to protect your rights.

Am I Eligible for Unemployment

In Pennsylvania, eligibility for unemployment benefits depends on more than just losing your job. The state reviews your earnings during what is called the base year to see if you meet the minimum wage requirements. It also looks closely at the reason your job ended. If you were laid off because of lack of work, you likely meet the separation requirement. If you quit or were fired, the circumstances matter. Quitting is only allowed when you have a compelling reason connected to your job, and firings are reviewed to see if misconduct was involved. You also need to be physically able to work, available for suitable employment, and actively applying for jobs each week.

At The Belt Law Firm, P.C., we help workers sort out whether they meet these standards before filing a claim or appeal. If you are unsure about your eligibility or have already been denied, call (570) 714-3343 to discuss your next step.

Unemployment Assistance: How Much Can I Receive

In Pennsylvania, the amount you receive in unemployment benefits depends on how much you earned during your base year, which is the twelve-month period the state uses to calculate eligibility. The state looks for your highest paid quarter in that year and uses it to set your weekly benefit amount. For most workers, payments fall somewhere between the state’s minimum and maximum benefit levels, and those figures are adjusted periodically. If you have dependents, you may also qualify for a partial allowance that increases your weekly payment.

When someone brings us their earnings history, we run the numbers the same way the state will, so there are no surprises. Sometimes the state could miss income that should count, especially if you worked multiple jobs or had overtime late in the year. We make sure all your wages are on record and, if the calculation is wrong, we push for a correction right away. If you are not sure whether the amount on your determination is accurate, call (570) 714-3343 and we can walk through it with you line by line.

What Paperwork Do I Need to File for Unemployment

When someone comes in to talk about filing for unemployment, the first thing we ask is what paperwork they already have. In Pennsylvania, the claim process moves faster when you can back up your answers with actual records. Bring your photo ID and Social Security card, but also bring anything that shows where you worked, how long you were there, and how much you earned. Pay stubs help. W-2s help. A letter from your employer about why the job ended can be important, especially if the reason is being disputed.
Can I Still Collect Unemployment if I Was Terminated?

Being fired does not automatically mean you cannot get unemployment benefits. The state looks at why you were terminated, not just the fact that you lost the job. If you were let go because of simple mistakes, not meeting performance goals, or other issues that do not amount to willful misconduct, you may still qualify. Willful misconduct is a legal standard that generally means you broke a known rule, acted recklessly, or showed disregard for your employer’s interests. The burden is on your employer to prove that is what happened.

At The Belt Law Firm, P.C., we help workers challenge denials that are based on an employer’s version of events. We review the termination details, gather evidence that supports your account, and present your case so the state understands the real reason you lost the job. Many people who are initially denied end up qualifying once the facts are clarified.

Can You Work Part-Time and Still Get Unemployment Benefits in Wilkes-Barre, Pennsylvania
You can work part-time and still receive unemployment benefits, but the state will reduce your payment based on what you earn. The Department of Labor and Industry looks at your gross weekly pay, subtracts a set allowance, and then adjusts your benefit for the week. If your earnings go over a certain amount, you will not receive payment for that week, but your claim can stay open for future weeks when you work less. Reporting every dollar, you make is important, because leaving out income can lead to overpayments or even penalties.
Contact a Wilkes-Barre Unemployment Compensation Attorney Today

If your unemployment benefits have been denied or delayed, every day without income makes it harder to keep up with bills and everyday expenses. The state gives you a short window to challenge a decision, and once that time runs out, your options become very limited. Many people come to us after trying to fix the problem themselves, only to find the system more complicated than they expected. That is where it helps to have someone who knows how these cases are decided and what information makes a difference.

At The Belt Law Firm, P.C., we work with people in Wilkes-Barre who are tired of getting nowhere with the unemployment office. We sit down with you, go through the letter you received, and figure out exactly what needs to be done before the deadline passes. If you are ready to take the next step, call (570) 714-3343 and we will get started.

On a professional level- Mr Belt was honest, answered all my questions and I knew what to expect. Very knowledgeable about the law. On a personal level- I hadn’t slept the night before the case and I had a bit of anxiety beforehand. Mr. Belt sat in the seating area with me and talked about coffee places. I was cool as a cucumber when it was time to go in. Bottom line is… I’d put all my trust in Mr. Belt and you could too. Also, the women that worked in the front office were always very kind on the phone and in person.

After extensive research, I decided to hire Timothy Belt as my workers’ compensation lawyer based on favorable reviews. Unfortunately, this decision proved to be a serious mistake. I anticipated that he would offer proper guidance and maintain effective communication, which are crucial responsibilities of a lawyer. His deficiency to do so resulted in significant financial strain and emotional distress. Due to his lack of effort and poor performance in my case, the best decision was to terminate his services and seek a new counsel. The difference was extremely noticeable and resulted in a fair outcome.

I just met with Timothy today. (Eric A.) He was very kind, very very knowledgeable about my unique circumstance and I decided to not continue my case in filing an appeal. He had a check in hand for close to a grand, I offered to pay him for his time as it seemed a bad decision to continue my unemployment claim with his knowledge on the subject, although he certainly would have. There were many hurdles, mostly my fault. I would have only ended up with a couple hundred bucks if we won. He was very very clear about that. I offered to pay him for his time today and for emails back and forth, and he just said, we 'll consider this a consultation at no charge. I can't guarantee that to everyone. But he continued to hear my plight after that and said he felt bad for the position I was in. Even gave his thoughts on the matter. Having had to work with many law firms over my years here on earth, I was very impressed with his knowledge and willing to do what he could to help. Thank you Timothy Belt! Much appreciated.
