Wilkes-Barre Workers’ Compensation for Nurses Injured in Slips, Trips, and Falls

Ask any nurse in Wilkes-Barre and they’ll tell you falls are part of the risk of the job. You move fast, you carry supplies, and you spend whole shifts on your feet. A wet tile near the nurses’ station, a cord stretched across the floor, or a cart left too close to the wall can put you down in a second. What follows is often more than a bruise. Fractured bones, torn muscles, or a wrenched back can keep you away from patients and out of work.

If a slip, trip, or fall has kept you from your nursing job, call The Belt Law Firm, P.C. at (570) 714-3343. We will sit down with you, review what happened, and push to secure the benefits you are entitled to under Pennsylvania law.

Common Causes of Slip and Fall Injuries for Nurses

Nursing is a job that keeps you moving nonstop. One minute you are carrying charts, the next you are rushing to a patient’s room or hauling equipment down the hall. Floors do not always stay dry, cords get left out, and supply carts are often in the way. It only takes a wet patch near a sink, a misplaced box, or a slippery stairwell for a nurse to end up on the ground. The result can be anything from a twisted ankle to a serious back or head injury.

Some of the most common slip, trip, and fall hazards for nurses in Wilkes-Barre hospitals and care facilities include:

Once you’re hurt, the stress piles up quickly. Missed shifts mean lost income, and medical bills only add to the problem.

Nurses in Wilkes-Barre are also injured in other common workplace situations that may qualify for benefits.

If you’ve been injured in a slip, trip, or fall while working as a nurse, call The Belt Law Firm, P.C. at (570) 714-3343. We’ll talk through your situation and take action to protect your claim.

Workers’ Comp Benefits Available to Injured Nurses

Workers’ compensation provides benefits to cover medical care, wage loss, and in some cases lasting conditions that keep you from returning to full duty. But those benefits are not always granted without a fight. Hospitals and insurance carriers often question how an injury occurred or try to send nurses back before they are ready. At The Belt Law Firm, P.C., we represent nurses across Pennsylvania to make sure their claims are taken seriously, and their benefits are fully secured. These cases are part of broader workers’ compensation claims for healthcare workers, where how and where a fall occurred matters.

If you are a nurse who was injured on the job, call The Belt Law Firm, P.C. at (570) 714-3343. We will listen to your situation, explain your options, and work to protect the benefits you are entitled to under Pennsylvania law.

The Impact of Slip and Fall Accidents in Hospitals

Anyone who has worked in a hospital knows the floors are not always safe. A spill outside a patient’s room, water tracked in from the ambulance bay, or a supply cart left in the wrong place can all create hazards. Nurses, aides, and techs often do not have time to stop and scan the floor before moving. One step on a slick tile or one trip over equipment can result in injuries that send a worker home for weeks.

These accidents are not just bad luck, they are workplace injuries, and Pennsylvania law gives hospital employees the right to seek workers’ compensation. That means coverage for treatment and a portion of lost wages, but it is rarely as simple as filling out a form. Employers may question how the fall happened, and insurance companies may slow down or deny claims. These situations often involve claim denials and delays, even when a fall happened during a regular shift. Understanding the workers’ compensation process can help nurses recognize when an insurer is not following the law.

The Belt Law Firm, P.C., takes on those fights for hospital nurses in Wilkes-Barre and across the state, making sure an avoidable hazard in a hallway does not end up costing someone their livelihood.

Common Questions about Workers’ Compensation for Nurses Hurt on the Job

Many nurses who file for workers’ compensation benefits have questions about what happens after they submit a claim. If you suffered an occupational injury, you may also be wondering what comes next and how you can return to work. You are not alone.

In some cases, nurses taken off work may also need help to collect unemployment benefits while a claim is pending.

Some of the most common questions about worker’s comp include:

When someone gets injured on the job and reports it to their employer, the employer’s insurance company has 21 days to either accept or deny the claim. If you file a claim, you may not know if the insurance company accepts it for three weeks. Oftentimes, the insurance company will begin to pay medical bills without actually accepting or denying the claim, especially if you are not working with a worker’s comp attorney. Making sure the best possible workers comp attorney is by your side can help ensure that your injury is accepted by the insurance company as work-related in a timely manner.

After your injury, your doctor may release you to “modified work duty.” Modified work duty is less physical work than your normal position. If you suffered a back injury, for example, you may be released to your job in a part-time role with no lifting or transferring of patients. In this case, your benefits may be reduced to two-thirds of the difference between how much you were earning before your injury and your wages in the part-time position.

If you decline to return to the job, the insurance company is likely to attempt to reduce your worker’s comp benefits. They can argue that you can perform available work and it is your choice not to perform this work so the loss of earnings is unrelated to the work injury—so it is appropriate to reduce, suspend or terminate your indemnity or wage-loss benefits. Many times, the workers’ compensation carrier makes this move after an “independent” medical examination; therefore, they have paid a physician for a medical opinion—frequently, contrary to your own doctor’s opinion—and then try to change your benefit status based upon this “bought” opinion. At The Belt Law Firm, P.C., we know when such a move is coming, know how to best prepare for such a move and know best how to respond to such a move to protect your medical and wage loss benefits.

Most employers and their insurance companies have a legal team, including lawyers, private investigators, medical case managers and adjusters, working to minimize the amount of money they spend on insurance claims. You deserve the same vigorous representation to fight for your right to benefits. The best way to protect your rights is to have an experienced worker’s comp legal team help you through the process.

On a professional level- Mr Belt was honest, answered all my questions and I knew what to expect. Very knowledgeable about the law. On a personal level- I hadn’t slept the night before the case and I had a bit of anxiety beforehand. Mr. Belt sat in the seating area with me and talked about coffee places. I was cool as a cucumber when it was time to go in. Bottom line is… I’d put all my trust in Mr. Belt and you could too. Also, the women that worked in the front office were always very kind on the phone and in person.

After extensive research, I decided to hire Timothy Belt as my workers’ compensation lawyer based on favorable reviews. Unfortunately, this decision proved to be a serious mistake. I anticipated that he would offer proper guidance and maintain effective communication, which are crucial responsibilities of a lawyer. His deficiency to do so resulted in significant financial strain and emotional distress. Due to his lack of effort and poor performance in my case, the best decision was to terminate his services and seek a new counsel. The difference was extremely noticeable and resulted in a fair outcome.

I just met with Timothy today. (Eric A.) He was very kind, very very knowledgeable about my unique circumstance and I decided to not continue my case in filing an appeal. He had a check in hand for close to a grand, I offered to pay him for his time as it seemed a bad decision to continue my unemployment claim with his knowledge on the subject, although he certainly would have. There were many hurdles, mostly my fault. I would have only ended up with a couple hundred bucks if we won. He was very very clear about that. I offered to pay him for his time today and for emails back and forth, and he just said, we 'll consider this a consultation at no charge. I can't guarantee that to everyone. But he continued to hear my plight after that and said he felt bad for the position I was in. Even gave his thoughts on the matter. Having had to work with many law firms over my years here on earth, I was very impressed with his knowledge and willing to do what he could to help. Thank you Timothy Belt! Much appreciated.

Frequently Asked Questions About Pennsylvania Workers’ Compensation

Report the injury to your employer as soon as possible and obtain any necessary medical treatment.
If the injury is not reported within 120 days, you will lose the right to file for compensation. You cannot legally be fired for reporting a work injury.
The employer reports your injury to their workers’ compensation insurer. If the insurance carrier accepts your claim, they will calculate any compensation owed and make payment. If your claim has not been accepted within 21 days of providing notice of the injury to your employer, your claim is likely denied.
If you receive a notice of denial, you can file a Claim Petition with the Pennsylvania Workers’ Compensation Bureau. Your Petition will be assigned to a Workers’ Compensation Judge. The Judge will schedule hearings, and both sides will be provided the opportunity to present evidence. If the claim is not voluntarily resolved, the judge will issue a Decision.
In most cases you have up to three years from the date of injury to file a Claim Petition.

Workers’ compensation insurance covers all medical expenses stemming from your work injury. Workers’ comp pays wage loss benefits until you are able to go back to work. Taking a lump-sum settlement may or may not make sense for your situation. You should get legal counsel before agreeing to a settlement.
