Injured While Lifting a Patient?

Wilkes-Barre Workers’ Comp for Nurses Injured in Patient Lifting or Transfer Accidents

You lift with a gait belt, you brace with your legs, you pivot, and the patient suddenly buckles. Maybe the Hoyer lift was down for maintenance. Maybe the second set of hands never arrived. On a busy shift in Wilkes-Barre, that single moment is all it takes for a sharp pull in your lower back, a shoulder that will not raise, or numbness running down a leg. Nurses tell us the same thing again and again. The pain sets in after the adrenaline fades, the charting is not complete, and now you cannot finish the shift or pick up the next one.

Pennsylvania Workers’ Compensation is designed to cover this type of injury. The first step is simple. Report it to your supervisor and get it in writing. The next step is where we come in. The Belt Law Firm, P.C. documents the transfer, the assist level, whether equipment was available, whether the brakes were locked, and what the ER note, and imaging results indicate. We handle calls from the insurer, meet deadlines, and ensure that wage loss is calculated correctly while your treating doctor directs care, not a company clinic. These cases are part of broader workers’ compensation claims for healthcare workers, and the details of how a transfer was handled matter.

If lifting or transferring a patient left you injured, call The Belt Law Firm, P.C. at (570) 714-3343. We will sit down with you, look at what happened, and work to make sure you receive the benefits the law provides.

Common Injuries Nurses Face When Lifting or Transferring Patients

Every nurse knows the strain of moving patients. Sometimes there’s no lift available, sometimes the second aide doesn’t show, sometimes the patient shifts their weight without warning.

The injuries we see most often include:

Nurses in Wilkes-Barre are also injured in other common workplace incidents that may qualify for benefits.

Pennsylvania law gives nurses the right to workers’ compensation, which can cover treatment costs and part of your lost wages. The challenge is that hospitals and insurance carriers don’t always make the process simple. That’s where The Belt Law Firm, P.C., steps in. We work with nurses across the state to make sure their claims are respected and their benefits are paid.

Workers’ Comp Benefits Available for Injured Nurses

Pennsylvania’s workers’ comp system is there to help, but it does not always run smoothly. Claims can be stalled, questioned, or denied. These situations often involve claim denials and delays, even when the injury happened during a routine patient transfer on the job. Some nurses are told to get back to work when their bodies are not ready. At The Belt Law Firm, P.C., we step in to make sure your claim is taken seriously and that you receive every benefit the law allows.

Understanding the workers’ compensation process can help nurses know when an insurance company is not following the law.

If you were injured while working as a nurse, call The Belt Law Firm, P.C. at (570) 714-3343. We will talk through what happened and take action to protect your benefits.

Why Safe Patient Handling Matters for Nurses’ Health

A patient who loses balance, equipment that is missing or broken, or a rushed transfer during a busy shift can all cause serious harm. Back injuries, shoulder tears, and herniated discs are some of the most common results. These injuries not only make it hard to keep working, but they can also affect a nurse’s health for years.

Safe patient handling programs exist to reduce these risks, but not every hospital or care facility has the right tools in place.

If you are a nurse who was hurt while lifting or transferring a patient, call The Belt Law Firm, P.C. at (570) 714-3343. We will review your situation, explain your rights, and take action to protect your claim.

Moving Patients a Common Cause of Injury in Health Care

Lifting and transferring patients is part of the job in every hospital and nursing home, but it is also one of the leading reasons health care workers get hurt. It only takes a patient losing balance, a piece of equipment not working, or trying to move someone without enough staff to leave you with a serious injury. We often see back strains, slipped discs, shoulder tears, and knee problems from these accidents. For many, the pain lasts long after the shift ends. In some cases, being taken off work may also mean needing help to collect unemployment benefits while a claim is pending.

At The Belt Law Firm, P.C., we work with health care workers across Pennsylvania to make sure their claims are taken seriously and that benefits are paid in full.

Workers’ Compensation Lawyers for Nurses in Wilkes-Barre

Nurses in Wilkes-Barre spend their shifts on the move. They lift patients, rush between rooms, handle equipment, and work through emergencies with little time to slow down. In that pace, injuries are common. Slips on wet floors, strained backs from transfers, or illnesses caught on the job can take you out of work and leave you wondering how to keep up with bills.

Hospitals and insurance carriers do not always make the process simple. Claims can be stalled, challenged, or cut short. Many injured nurses choose to speak with a Wilkes-Barre work injury lawyer to protect their rights and avoid mistakes that can cost them benefits. At The Belt Law Firm, P.C., we represent nurses across Luzerne County who find themselves in that situation. We know how to document what happened, keep claims moving, and make sure your benefits are protected under state law.

If you are a nurse in Wilkes-Barre who was injured at work, call The Belt Law Firm, P.C. at (570) 714-3343. We will listen to your story, explain your options, and take action to secure the benefits you deserve. We also provide Spanish-speaking assistance to ensure language is never a barrier to justice.

On a professional level- Mr Belt was honest, answered all my questions and I knew what to expect. Very knowledgeable about the law. On a personal level- I hadn’t slept the night before the case and I had a bit of anxiety beforehand. Mr. Belt sat in the seating area with me and talked about coffee places. I was cool as a cucumber when it was time to go in. Bottom line is… I’d put all my trust in Mr. Belt and you could too. Also, the women that worked in the front office were always very kind on the phone and in person.

After extensive research, I decided to hire Timothy Belt as my workers’ compensation lawyer based on favorable reviews. Unfortunately, this decision proved to be a serious mistake. I anticipated that he would offer proper guidance and maintain effective communication, which are crucial responsibilities of a lawyer. His deficiency to do so resulted in significant financial strain and emotional distress. Due to his lack of effort and poor performance in my case, the best decision was to terminate his services and seek a new counsel. The difference was extremely noticeable and resulted in a fair outcome.

I just met with Timothy today. (Eric A.) He was very kind, very very knowledgeable about my unique circumstance and I decided to not continue my case in filing an appeal. He had a check in hand for close to a grand, I offered to pay him for his time as it seemed a bad decision to continue my unemployment claim with his knowledge on the subject, although he certainly would have. There were many hurdles, mostly my fault. I would have only ended up with a couple hundred bucks if we won. He was very very clear about that. I offered to pay him for his time today and for emails back and forth, and he just said, we 'll consider this a consultation at no charge. I can't guarantee that to everyone. But he continued to hear my plight after that and said he felt bad for the position I was in. Even gave his thoughts on the matter. Having had to work with many law firms over my years here on earth, I was very impressed with his knowledge and willing to do what he could to help. Thank you Timothy Belt! Much appreciated.

Frequently Asked Questions About Pennsylvania Workers’ Compensation

Report the injury to your employer as soon as possible and obtain any necessary medical treatment.
If the injury is not reported within 120 days, you will lose the right to file for compensation. You cannot legally be fired for reporting a work injury.
The employer reports your injury to their workers’ compensation insurer. If the insurance carrier accepts your claim, they will calculate any compensation owed and make payment. If your claim has not been accepted within 21 days of providing notice of the injury to your employer, your claim is likely denied.
If you receive a notice of denial, you can file a Claim Petition with the Pennsylvania Workers’ Compensation Bureau. Your Petition will be assigned to a Workers’ Compensation Judge. The Judge will schedule hearings, and both sides will be provided the opportunity to present evidence. If the claim is not voluntarily resolved, the judge will issue a Decision.
In most cases you have up to three years from the date of injury to file a Claim Petition.
Any injury or illness that is work-related. It could be a fall, a burn or other workplace incident. It also covers occupational illnesses and repetitive stress injuries that develop over time from toxic exposures or the rigors of the job.

Workers’ compensation insurance covers all medical expenses stemming from your work injury. Workers’ comp pays wage loss benefits until you are able to go back to work. If you suffer an amputation or disfigurement to your face or neck, you may be entitled to additional disability benefits (even if you are still able to work).

Taking a lump-sum settlement may or may not make sense for your situation. You should get legal counsel before agreeing to a settlement.

Workers’ compensation is a complex process. If you fail to follow specific steps and timelines, you risk damaging your claim or not getting the full spectrum of compensation available. Speak with an attorney to ensure your rights are protected.
