Steps To Take Immediately After A Work Accident

If you’ve been hurt at work or developed a health condition related to your job, it’s crucial to act quickly to safeguard both your well-being and your legal rights.

Here’s what you should do immediately following a workplace accident, injury, or diagnosis:

Your employer may have a designated list of medical provider for workplace injuries. If so, you are required to choose your treatment provider from this list for the first 90 days if you want the workers’ compensation carrier to pay for your treatment.  After the 90-day period, you are free to treat with any doctor you choose.

Let us advocate for your rights so you can focus on recovery. Call (570) 714-3343 for a free consultation. Hablamos Español. Llámenos hoy.

Eligibility Rules For Workers’ Comp In West Pittston, PA

In West Pittston, most employees — whether full-time, part-time, or seasonal — are eligible for workers’ compensation benefits if they are hurt or become ill because of their work. The critical requirement is that an injury or illness must occur in the course of employment. This includes everything from sudden workplace accidents to repetitive motion injuries and occupational illnesses that develop gradually over time.

There are certain categories of workers who typically aren’t covered under Pennsylvania workers’ compensation system, such as:

Additionally, even eligible employees could lose benefits if the injury was caused by intoxication, illegal drug use, or intentional misconduct.

Because the rules surrounding workers’ compensation can be complicated, it’s important to have guidance. If you have questions about your eligibility or need help after a denied claim, our experienced workplace injury attorneys are ready to support you. Call us today at (570) 714-3343 for a free consultation.

Why Hiring a Workers’ Comp Attorney Matters

Although some workers’ compensation claims are approved without issue, many workers face obstacles during the claim process. It’s not uncommon for initial claims to be denied due to simple mistakes — like missing important deadlines, failing to clearly connect the injury to the workplace, or leaving out critical details in the paperwork. Working with an experienced workers’ compensation attorney can help you avoid these pitfalls. A lawyer ensures that your claim is filed correctly, on time, and backed with strong evidence, giving you the best chance of success from the start.

If your claim has already been denied, don’t lose hope. You still have the right to file a Claim Petition. An attorney can help you appeal and fight for the benefits you deserve after a work-related injury.

Workers’ Comp Denials

Getting denied for workers’ compensation benefits can be discouraging—especially when you’re already dealing with an injury. Unfortunately, initial denials are common, even in cases where workers later receive benefits through filing a Claim Petition. Knowing why a claim was denied is the first step toward fixing the problem.

Common reasons for denial include:

  1.  Not enough medical evidence to support your injury
  2.  Failing to seek prompt medical attention
  1.  Missing the deadline to report the injury to your employer
  2.  Oversight or error by the insurance adjuster
  1.  Filing your claim too late (after the three-year limit)

A denial doesn’t always mean it’s the end of the road. In many cases, it’s possible to challenge the decision and still receive benefits. We’ll take the time to understand your specific situation and provide honest, practical advice on what steps to take next.

Let us shoulder the legal burden while you focus on your recovery and well-being. Contact our West Pittston workers’ compensation lawyers so we can schedule an appointment to review your claim or appeal. Call us today at (570) 714-3343 for a free case evaluation. Hablamos Español. Llámenos hoy.

On a professional level- Mr Belt was honest, answered all my questions and I knew what to expect. Very knowledgeable about the law. On a personal level- I hadn’t slept the night before the case and I had a bit of anxiety beforehand. Mr. Belt sat in the seating area with me and talked about coffee places. I was cool as a cucumber when it was time to go in. Bottom line is… I’d put all my trust in Mr. Belt and you could too. Also, the women that worked in the front office were always very kind on the phone and in person.

After extensive research, I decided to hire Timothy Belt as my workers’ compensation lawyer based on favorable reviews. Unfortunately, this decision proved to be a serious mistake. I anticipated that he would offer proper guidance and maintain effective communication, which are crucial responsibilities of a lawyer. His deficiency to do so resulted in significant financial strain and emotional distress. Due to his lack of effort and poor performance in my case, the best decision was to terminate his services and seek a new counsel. The difference was extremely noticeable and resulted in a fair outcome.

I just met with Timothy today. (Eric A.) He was very kind, very very knowledgeable about my unique circumstance and I decided to not continue my case in filing an appeal. He had a check in hand for close to a grand, I offered to pay him for his time as it seemed a bad decision to continue my unemployment claim with his knowledge on the subject, although he certainly would have. There were many hurdles, mostly my fault. I would have only ended up with a couple hundred bucks if we won. He was very very clear about that. I offered to pay him for his time today and for emails back and forth, and he just said, we 'll consider this a consultation at no charge. I can't guarantee that to everyone. But he continued to hear my plight after that and said he felt bad for the position I was in. Even gave his thoughts on the matter. Having had to work with many law firms over my years here on earth, I was very impressed with his knowledge and willing to do what he could to help. Thank you Timothy Belt! Much appreciated.

Frequently Asked Questions About Workers’ Compensation in West Pittston, PA

In West Pittston, you are required to report your injury to your employer within 120 days of the incident or the date you first realized you were injured. It’s best to report it as soon as possible, as failing to meet this deadline can jeopardize your ability to receive benefits.

Workers’ compensation operates on a no-fault basis, meaning you don’t have to prove that your employer was at fault for your injuries. Similarly, the insurer cannot deny your claim by arguing that you were negligent in causing the injury.

However, there are various aspects of your claim that an insurance company may challenge, such as:

  • The timing of your injury
  • Whether your work contributed to or worsened your injury
  • The type of treatment you need
  • Your average earnings
  • Whether a pre-existing condition is responsible for your condition rather than the injury
  • If you violated your employer’s safety protocols and caused the accident

The benefits you are entitled to depend on these factors. It’s crucial to provide a clear and truthful account of the incident to your workers’ compensation attorney, so they can properly evaluate how the law applies to your case.

Your workers’ compensation claim might be denied for several reasons, including failing to report your injury promptly, submitting the claim after leaving your job, or not following the required procedures. That’s why having legal support can be crucial in ensuring your rights are protected throughout the process.

Common reasons your work injury claim could be rejected include:

  • Delayed injury report: In Pennsylvania, you must inform your employer about your injury within 120 days. Failing to do so could result in your claim being denied, as the workers’ compensation system requires timely reporting.
  • Discrepancy between the accident report and medical records: If the details in the accident report differ from the medical findings, it may raise questions. For example, if you report a leg injury from a fall but later discover a concussion that wasn’t mentioned in the report, the insurance company might view this as inconsistent.
  • Filing after termination or layoff: If you file a claim after losing your job, the insurance company might consider it suspicious, potentially leading to an immediate denial.
  • Lack of witnesses: If no one saw the accident happen, your employer might argue that the injury didn’t occur while you were at work, complicating your claim.
  • Failure to cooperate: Not engaging with the claims process, such as refusing to sign necessary documents or provide requested statements, can hurt your case.

If your workers’ compensation claim has been denied, don’t hesitate to seek legal guidance. Contact The Belt Law Firm, P.C., at (570) 714-3343, and get your free case review today!

If you receive a notice of denial, you can file a Claim Petition with the Pennsylvania Workers’ Compensation Bureau. Your Petition will be assigned to a Workers’ Compensation Judge. The Judge will schedule hearings, and both sides will be provided the opportunity to present evidence. If the claim is not voluntarily resolved, the judge will issue a Decision.

In most cases you have up to three years from the date of injury to file a Claim Petition.

Any injury or illness that is work-related. It could be a fall, a burn or other workplace incident. It also covers occupational illnesses and repetitive stress injuries that develop over time from toxic exposures or the rigors of the job.

Workers’ compensation insurance covers all medical expenses stemming from your work injury. Workers’ comp pays wage loss benefits until you are able to go back to work. If you suffer an amputation or disfigurement to your face or neck, you may be entitled to additional disability benefits (even if you are still able to work).

Taking a lump-sum settlement may or may not make sense for your situation. You should get legal counsel before agreeing to a settlement.

Workers’ compensation is a complex process. If you fail to follow specific steps and timelines, you risk damaging your claim or not getting the full spectrum of compensation available. Speak with an attorney to ensure your rights are protected.

There is no upfront or out-of-pocket cost to you. We provide a free initial consultation. You do not pay any legal fees unless and until we recover benefits for you.
