Workplace Injuries We See Most Often in Scranton, PA

After handling cases for workers all over Scranton, I can tell you one thing for sure, no two injuries are ever the same. Some happen in a second. Others build up slowly until one day your back gives out, your wrist goes numb, or your knee just won’t bend the way it used to. I’ve seen every kind of situation you can imagine, and no matter how it happens, the result is the same: your life gets harder while the bills keep coming. These are all examples of workplace injuries that can qualify for workers’ compensation benefits.

Here are some of the injuries we see most often across Lackawanna County:

  • A nurse who hurts her shoulder helping a patient back into bed
  • A warehouse worker who slips on a wet floor and breaks an ankle
  • A truck driver with constant pain shooting down his leg from sitting too long
  • A line worker whose hands go numb after years of doing the same motion
  • A construction worker who falls off a ladder because someone rushed the setup
  • A factory employee who injures their back lifting a heavy box

Injuries involving nurses often happen during routine patient care, including patient lifting and transfer injuries, which are among the most common hospital-related work injuries we see in Scranton. Other claims involve nurses injured in slip, trip, or fall accidents or while responding to combative patients.

None of these people set out to file a claim. They just wanted to heal and get back to work. But when the insurance company starts dragging its feet or questioning your story, that’s where I step in. My job is to make sure you get treated fairly and that you don’t have to fight this battle on your own.

If you were hurt at work here in Scranton, give The Belt Law Firm, P.C. a call at (570) 714-3343. You’ll talk directly with someone who understands what you’re going through, not a call center, not a chatbot, just real people ready to help you get your life back on track

How Scranton Workers’ Compensation Benefits Work

Most people don’t learn how the workers’ compensation process works until they’re thrown into it, usually after an injury they didn’t see coming. You go from worrying about doing your job to worrying about how to pay for doctor visits and how long you’ll be out of work. In Pennsylvania, the system is supposed to help with that. It should cover your medical treatment and part of your wages while you’re healing. That’s the idea, anyway.

Sometimes claims sit in limbo for weeks due to denials and delays that leave injured workers waiting for benefits. In other cases, benefits start and stop without warning. More often than not, the people who worked the hardest are the ones left fighting for what they’re already owed. That’s why we step in to make sure your claim is handled properly and that the insurance company keeps its promises. We deal with the paperwork, the doctors, and the adjusters so you can focus on getting back on your feet. We also help injured workers dealing with pressure to return to work before their doctor says they’re ready.

If you’re hurt and not sure where your claim stands, don’t try to figure it out alone. Call The Belt Law Firm, P.C. at (570) 714-3343 and talk to someone who’s helped countless Scranton workers through this exact situation. One call can make a big difference in how your case and your recovery move forward.

Many common questions about medical care, lost wages, and return-to-work issues are answered in our workers’ compensation FAQ.

What to Do After a Work Injury in Scranton

First, tell your supervisor right away. Don’t brush it off or try to “tough it out.” Get it in writing that you reported the injury. Then go see a doctor as soon as possible. Pennsylvania law allows your employer to give you a list of approved doctors, but that doesn’t mean you have to settle for rushed care. Keep every record, note, and bill—those details matter later when the insurance company starts asking questions.

If you start getting mixed messages about what’s covered, or if your checks never come, that’s when it’s time to call us. At The Belt Law Firm, P.C., we deal with this system every day and know how to make it work the way it’s supposed to. Call The Belt Law Firm, P.C. at (570) 714-3343.

On a professional level- Mr Belt was honest, answered all my questions and I knew what to expect. Very knowledgeable about the law. On a personal level- I hadn’t slept the night before the case and I had a bit of anxiety beforehand. Mr. Belt sat in the seating area with me and talked about coffee places. I was cool as a cucumber when it was time to go in. Bottom line is… I’d put all my trust in Mr. Belt and you could too. Also, the women that worked in the front office were always very kind on the phone and in person.

After extensive research, I decided to hire Timothy Belt as my workers’ compensation lawyer based on favorable reviews. Unfortunately, this decision proved to be a serious mistake. I anticipated that he would offer proper guidance and maintain effective communication, which are crucial responsibilities of a lawyer. His deficiency to do so resulted in significant financial strain and emotional distress. Due to his lack of effort and poor performance in my case, the best decision was to terminate his services and seek a new counsel. The difference was extremely noticeable and resulted in a fair outcome.

I just met with Timothy today. (Eric A.) He was very kind, very very knowledgeable about my unique circumstance and I decided to not continue my case in filing an appeal. He had a check in hand for close to a grand, I offered to pay him for his time as it seemed a bad decision to continue my unemployment claim with his knowledge on the subject, although he certainly would have. There were many hurdles, mostly my fault. I would have only ended up with a couple hundred bucks if we won. He was very very clear about that. I offered to pay him for his time today and for emails back and forth, and he just said, we 'll consider this a consultation at no charge. I can't guarantee that to everyone. But he continued to hear my plight after that and said he felt bad for the position I was in. Even gave his thoughts on the matter. Having had to work with many law firms over my years here on earth, I was very impressed with his knowledge and willing to do what he could to help. Thank you Timothy Belt! Much appreciated.

Frequently Asked Questions About Workers’ Compensation in Scranton, PA

Here are some of the most common questions we are asked. If you can’t find an answer here, please contact us. We’ll be happy to assist you and answer your questions.

In Scranton, you are required to report your injury to your employer within 120 days of the incident or the date you first realized you were injured. It’s best to report it as soon as possible, as failing to meet this deadline can jeopardize your ability to receive benefits.

Workers’ compensation operates on a no-fault basis, meaning you don’t have to prove that your employer was at fault for your injuries. Similarly, the insurer cannot deny your claim by arguing that you were negligent in causing the injury.

However, there are various aspects of your claim that an insurance company may challenge, such as:

  • The timing of your injury
  • Whether your work contributed to or worsened your injury
  • The type of treatment you need
  • Your average earnings
  • Whether a pre-existing condition is responsible for your condition rather than the injury
  • If you violated your employer’s safety protocols and caused the accident

The benefits you are entitled to depend on these factors. It’s crucial to provide a clear and truthful account of the incident to your workers’ compensation attorney, so they can properly evaluate how the law applies to your case.

Your workers’ compensation claim might be denied for several reasons, including failing to report your injury promptly, submitting the claim after leaving your job, or not following the required procedures. That’s why having legal support can be crucial in ensuring your rights are protected throughout the process.

Common reasons your work injury claim could be rejected include:

  • Delayed injury report: In Pennsylvania, you must inform your employer about your injury within 120 days. Failing to do so could result in your claim being denied, as the workers’ compensation system requires timely reporting.
  • Discrepancy between the accident report and medical records: If the details in the accident report differ from the medical findings, it may raise questions. For example, if you report a leg injury from a fall but later discover a concussion that wasn’t mentioned in the report, the insurance company might view this as inconsistent.
  • Filing after termination or layoff: If you file a claim after losing your job, the insurance company might consider it suspicious, potentially leading to an immediate denial.
  • Lack of witnesses: If no one saw the accident happen, your employer might argue that the injury didn’t occur while you were at work, complicating your claim.
  • Failure to cooperate: Not engaging with the claims process, such as refusing to sign necessary documents or provide requested statements, can hurt your case.

If your workers’ compensation claim has been denied, don’t hesitate to seek legal guidance. Contact The Belt Law Firm, P.C., at (570) 714-3343, and get your free case review today!

If you receive a notice of denial, you can file a Claim Petition with the Pennsylvania Workers’ Compensation Bureau. Your Petition will be assigned to a Workers’ Compensation Judge. The Judge will schedule hearings, and both sides will be provided the opportunity to present evidence. If the claim is not voluntarily resolved, the judge will issue a Decision.

In most cases you have up to three years from the date of injury to file a Claim Petition.

Any injury or illness that is work-related. It could be a fall, a burn or other workplace incident. It also covers occupational illnesses and repetitive stress injuries that develop over time from toxic exposures or the rigors of the job.

Workers’ compensation insurance covers all medical expenses stemming from your work injury. Workers’ comp pays wage loss benefits until you are able to go back to work. If you suffer an amputation or disfigurement to your face or neck, you may be entitled to additional disability benefits (even if you are still able to work).

Taking a lump-sum settlement may or may not make sense for your situation. You should get legal counsel before agreeing to a settlement.

Workers’ compensation is a complex process. If you fail to follow specific steps and timelines, you risk damaging your claim or not getting the full spectrum of compensation available. Speak with an attorney to ensure your rights are protected.

There is no upfront or out-of-pocket cost to you. We provide a free initial consultation. You do not pay any legal fees unless and until we recover benefits for you.
