Common Workplace Injuries We Handle in Laflin, Pennsylvania

At The Belt Law Firm, P.C., we have represented injured workers across Pennsylvania for over fourteen years, and we have seen just about every type of workplace injury there is. From sudden accidents on construction sites to repetitive strain injuries developed over years in a factory or office, our focus is getting you the medical treatment and wage loss benefits the law provides.

Common injuries we handle include…

  • Back and neck injuries
  • Knee and shoulder damage
  • Carpal tunnel syndrome
  • Head trauma
  • Crush injuries and
  • Occupational diseases like respiratory conditions or hearing loss.

No matter how your injury happened, if it arose out of your job duties, you are likely entitled to workers’ compensation under Pennsylvania law. The problem is most injured workers are not told the full extent of their rights. Employers and insurance carriers often downplay injuries or push people to return to work before they are ready. We know how to challenge these tactics and make sure your benefits reflect the seriousness of your condition and the impact it has on your life.

If you are dealing with a work-related injury and need someone to protect your future, contact The Belt Law Firm, P.C. today at (570) 714-3343.

Injured at Work? Here’s What Workers’ Compensation Covers

Workers’ comp should cover your medical bills, lost wages if you cannot work, and any specific loss benefits if you suffer permanent loss of a body part. Unfortunately, employers and insurance carriers often try to cut corners or deny rightful claims, which is why having a focused and experienced firm on your side is essential.

If you or someone close to you has been hurt on the job, it’s important to act quickly. In Pennsylvania, you have up to 120 days to report a workplace injury—but the sooner you notify your employer, the better your chances of protecting your rights.

If you are facing uncertainty after a workplace injury, now is the time to take action. Call The Belt Law Firm, P.C., at (570) 714-3343 for a free consultation with a firm that focuses on protecting Pennsylvania’s injured workers. We are here to make sure your rights are not just protected but enforced.

Can I Be Fired for Filing a Workers’ Comp Claim

It’s a question we’ve heard time and time again and honestly; it’s one that keeps a lot of injured workers up at night. You get hurt, you do the right thing by reporting it, and then you start looking over your shoulder wondering if your job is on the line. Let me be clear: in Pennsylvania, your employer cannot fire you just because you filed a workers’ comp claim. That kind of retaliation is flat out wrong, and we do not take it lightly.

Now that does not mean they will come out and say you are being let go because you filed a claim. Sometimes it is more subtle. Your hours get cut, your responsibilities change, or suddenly you are being written up for things that never mattered before. That is where we come in. At The Belt Law Firm, P.C., we have spent decades looking closely at these situations and calling out the red flags others ignore. We know the patterns and we know how to respond.

If your instincts are telling you something feels off since reporting your work injury, it is time to talk. You do not need to carry that worry by yourself. Call The Belt Law Firm, P.C., at (570) 714-3343 and we will help you stand your ground and protect what is rightfully yours.

And we do it with the personal attention and honesty injured workers deserve.

Injured at work in Laflin? Don’t wait and hope the system does the right thing. Call The Belt Law Firm, P.C., at (570) 714-3343 for a free consultation. We’ll make sure you fully understand your rights before delays or mistakes put your benefits at risk under Pennsylvania law.

We Only Represent Injured Workers — Never Insurance Companies

We stand with one group and one group only — injured workers across Pennsylvania. That focus is intentional. It means we are never caught in the middle. It means every strategy and every phone call is made with one goal in mind: protecting your rights and making sure you are treated fairly under Pennsylvania’s workers’ compensation laws.

When you are hurt on the job, the people who promised to support you often step back. Suddenly, your claim is under review, your checks are delayed, or your treatment is being questioned. We have handled thousands of these cases. We know how to challenge denied claims, push back against independent medical exams that are anything but independent, and make sure your benefits are paid in full and on time. With decades of experience dedicated to workers’ comp, we know how to keep the pressure on so you are not left behind.

On a professional level- Mr Belt was honest, answered all my questions and I knew what to expect. Very knowledgeable about the law. On a personal level- I hadn’t slept the night before the case and I had a bit of anxiety beforehand. Mr. Belt sat in the seating area with me and talked about coffee places. I was cool as a cucumber when it was time to go in. Bottom line is… I’d put all my trust in Mr. Belt and you could too. Also, the women that worked in the front office were always very kind on the phone and in person.

After extensive research, I decided to hire Timothy Belt as my workers’ compensation lawyer based on favorable reviews. Unfortunately, this decision proved to be a serious mistake. I anticipated that he would offer proper guidance and maintain effective communication, which are crucial responsibilities of a lawyer. His deficiency to do so resulted in significant financial strain and emotional distress. Due to his lack of effort and poor performance in my case, the best decision was to terminate his services and seek a new counsel. The difference was extremely noticeable and resulted in a fair outcome.

I just met with Timothy today. (Eric A.) He was very kind, very very knowledgeable about my unique circumstance and I decided to not continue my case in filing an appeal. He had a check in hand for close to a grand, I offered to pay him for his time as it seemed a bad decision to continue my unemployment claim with his knowledge on the subject, although he certainly would have. There were many hurdles, mostly my fault. I would have only ended up with a couple hundred bucks if we won. He was very very clear about that. I offered to pay him for his time today and for emails back and forth, and he just said, we 'll consider this a consultation at no charge. I can't guarantee that to everyone. But he continued to hear my plight after that and said he felt bad for the position I was in. Even gave his thoughts on the matter. Having had to work with many law firms over my years here on earth, I was very impressed with his knowledge and willing to do what he could to help. Thank you Timothy Belt! Much appreciated.

Frequently Asked Questions About Workers’ Compensation in Laflin, PA

In Laflin, you are required to report your injury to your employer within 120 days of the incident or the date you first realized you were injured. It’s best to report it as soon as possible, as failing to meet this deadline can jeopardize your ability to receive benefits.

Workers’ compensation operates on a no-fault basis, meaning you don’t have to prove that your employer was at fault for your injuries. Similarly, the insurer cannot deny your claim by arguing that you were negligent in causing the injury.

However, there are various aspects of your claim that an insurance company may challenge, such as:

  • The timing of your injury
  • Whether your work contributed to or worsened your injury
  • The type of treatment you need
  • Your average earnings
  • Whether a pre-existing condition is responsible for your condition rather than the injury
  • If you violated your employer’s safety protocols and caused the accident

The benefits you are entitled to depend on these factors. It’s crucial to provide a clear and truthful account of the incident to your workers’ compensation attorney, so they can properly evaluate how the law applies to your case.

Your workers’ compensation claim might be denied for several reasons, including failing to report your injury promptly, submitting the claim after leaving your job, or not following the required procedures. That’s why having legal support can be crucial in ensuring your rights are protected throughout the process.

Common reasons your work injury claim could be rejected include:

  • Delayed injury report: In Pennsylvania, you must inform your employer about your injury within 120 days. Failing to do so could result in your claim being denied, as the workers’ compensation system requires timely reporting.
  • Discrepancy between the accident report and medical records: If the details in the accident report differ from the medical findings, it may raise questions. For example, if you report a leg injury from a fall but later discover a concussion that wasn’t mentioned in the report, the insurance company might view this as inconsistent.
  • Filing after termination or layoff: If you file a claim after losing your job, the insurance company might consider it suspicious, potentially leading to an immediate denial.
  • Lack of witnesses: If no one saw the accident happen, your employer might argue that the injury didn’t occur while you were at work, complicating your claim.
  • Failure to cooperate: Not engaging with the claims process, such as refusing to sign necessary documents or provide requested statements, can hurt your case.

If your workers’ compensation claim has been denied, don’t hesitate to seek legal guidance. Contact The Belt Law Firm, P.C., at (570) 714-3343, and get your free case review today!

If you receive a notice of denial, you can file a Claim Petition with the Pennsylvania Workers’ Compensation Bureau. Your Petition will be assigned to a Workers’ Compensation Judge. The Judge will schedule hearings, and both sides will be provided the opportunity to present evidence. If the claim is not voluntarily resolved, the judge will issue a Decision.

In most cases you have up to three years from the date of injury to file a Claim Petition.

Any injury or illness that is work-related. It could be a fall, a burn or other workplace incident. It also covers occupational illnesses and repetitive stress injuries that develop over time from toxic exposures or the rigors of the job.

Workers’ compensation insurance covers all medical expenses stemming from your work injury. Workers’ comp pays wage loss benefits until you are able to go back to work. If you suffer an amputation or disfigurement to your face or neck, you may be entitled to additional disability benefits (even if you are still able to work).

Taking a lump-sum settlement may or may not make sense for your situation. You should get legal counsel before agreeing to a settlement.

Workers’ compensation is a complex process. If you fail to follow specific steps and timelines, you risk damaging your claim or not getting the full spectrum of compensation available. Speak with an attorney to ensure your rights are protected.

There is no upfront or out-of-pocket cost to you. We provide a free initial consultation. You do not pay any legal fees unless and until we recover benefits for you.
