Danville Workers’ Compensation for Nurses Injured in Slips, Trips, and Falls

Danville Workers’ Compensation for Nurses Injured in Slips, Trips, and Falls

Helping Nurses, Doctors, EMTs, Home Health Aides, and others secure Danville Workers’ Compensation Benefits

If you’re a nurse at Geisinger Medical Center or one of the clinics around Danville and you slipped on a wet floor, caught your foot on a cart, or fell while moving too fast between rooms, I get why you’re frustrated. Most nurses don’t have time to be hurt. You shake it off, finish your shift, and hope it gets better.

In other situations, falls happen when nurses are responding to combative patients in tight or unpredictable spaces. Then a few days later you’re still limping, or your back locks up when you try to lift a patient, and suddenly this “little fall” is ruining your life.

You’re entitled to care and support under Pennsylvania’s workers’ compensation law, and when something goes wrong at work the right response matters. At The Belt Law Firm, P.C., we help nurses navigate this system from day one: getting the incident reported, making sure your doctor is in the loop, and protecting your income while you recover.

If you’ve been hurt on the job in Danville, call (570) 714-3343 and talk with a worker’s comp attorney who understands nursing injuries, knows how hospitals operate, and fights to make sure you’re treated fairly. Se habla español. Llámenos hoy.

Common Slip, Trip, and Fall Injuries Nurses Experience on the Job

Here are the kinds of injuries we hear about most often from nurses who’ve taken a fall at work:

These are not ‘you’ll be fine by tomorrow’ workplace injuries. They interfere with your ability to do your job, and they take a toll outside the hospital too. In many cases, nurses first notice these problems when trying to return to patient lifting or transfers after a fall. If this sounds familiar, don’t try to just push through it. Call The Belt Law Firm, P.C. at (570) 714-3343 and tell me what happened. We’ll talk it through and figure out the best way to protect you while you recover.

What Injured Nurses in Danville Should Do After a Workplace Fall

If you were here in my office, or if we were just talking on the phone, I’d tell you the same thing as I tell every nurse who calls me after a fall at work: don’t ignore it. I know how it goes. You finish the shift, you push through the pain, you assume it will calm down. But falls have a way of getting worse when your whole job depends on lifting, helping patients, and being on your feet all day. Just let your manager know what happened. You don’t need fancy wording. A simple note saying when and where you fell is enough. Then get checked out. Even if you think it’s nothing, let a doctor take a look. It protects your health and your rights.

After that, give me a call so we can walk through the workers’ compensation process together. We’ll walk through what happened, how you’re feeling, and anything the hospital has told you so far. You don’t need to know the workers’ comp rules or have any paperwork prepared. That’s my job. I’ll help you get the treatment you need, make sure you’re not losing wages while you recover, and step in if anyone starts making things more difficult than they should be.

Workers’ Compensation Benefits Available to Injured Healthcare Staff in Danville

In Pennsylvania, when a nurse or any hospital employee is injured on the job, workers’ compensation is supposed to step in and cover your medical care and part of the income you’re losing while you’re out. That includes doctor visits, imaging, medication, therapy, and in many cases time away from work if you can’t safely perform your duties. I know it can feel strange to talk about benefits when you’re used to being the one helping others, but this system exists to protect you too.

Every situation looks a little different. Some people are back within a few weeks. Others need more time. What matters is that we make sure the benefits you’re entitled to are provided, without excuses or delays.

If you were injured while working at a hospital or clinic here in Danville, call The Belt Law Firm, P.C. at (570) 714-3343.

Common Questions about Workers’ Compensation for Nurses Hurt on the Job

Many nurses that file for worker’s compensation benefits have questions about what happens after they file a claim, which we address in our workers’ compensation FAQ. If you suffered an occupational injury, you, too, may be wondering what happens after you file and how you can return to work. Know you are not alone.

Some of the most common questions about worker’s comp include:

When someone gets injured on the job and reports it to their employer, the employer’s insurance company has 21 days to either accept or deny the claim. If you file a claim, you may not know if the insurance company accepts it for three weeks. Oftentimes, the insurance company will begin to pay medical bills without actually accepting or denying the claim, especially if you are not working with a worker’s comp attorney. Making sure the best possible workers comp attorney is by your side can help ensure that your injury is accepted by the insurance company as work-related in a timely manner.

After your injury, your doctor may release you to “modified work duty.” Modified work duty is less physical work than your normal position. If you suffered a back injury, for example, you may be released to your job in a part-time role with no lifting or transferring of patients. In this case, your benefits may be reduced to two-thirds of the difference between how much you were earning before your injury and your wages in the part-time position.

If you decline to return to the job, the insurance company is likely to attempt to reduce your worker’s comp benefits. They can argue that you can perform available work and it is your choice not to perform this work so the loss of earnings is unrelated to the work injury—so it is appropriate to reduce, suspend or terminate your indemnity or wage-loss benefits. Many times, the workers’ compensation carrier makes this move after an “independent” medical examination; therefore, they have paid a physician for a medical opinion—frequently, contrary to your own doctor’s opinion—and then try to change your benefit status based upon this “bought” opinion. At The Belt Law Firm, P.C., we know when such a move is coming, know how to best prepare for such a move and know best how to respond to such a move to protect your medical and wage loss benefits.

Most employers and their insurance companies have a legal team, including lawyers, private investigators, medical case managers and adjusters, working to minimize the amount of money they spend on insurance claims. You deserve the same vigorous representation to fight for your right to benefits. The best way to protect your rights is to have an experienced worker’s comp legal team help you through the process.

Why Nurses Hurt in Hospital Falls Should Not Delay Their Workers' Compensation Claim

After a fall at the hospital, it’s easy to think, “I’ll be fine tomorrow.” Most nurses keep going because that’s how the job works. But when the soreness doesn’t go away, or when lifting a patient suddenly feels different, that’s your body telling you not to ignore it. Waiting too long to speak up can make things harder and lead to denials and delays that could have been avoided. People forget details. Supervisors change. Paperwork gets tricky. Reporting sooner simply gives you a clearer path to care and protects you if the injury turns into something that keeps you out of work longer than you expected.

Once you’ve let the hospital know what happened, the next step is making sure the benefits you’re entitled to don’t get delayed. That includes medical treatment and money coming in if you’re off the schedule. If a claim is denied or stalled, injured nurses may still have options through workers’ compensation appeals. You don’t have to argue with anyone or explain every detail to an insurance company. We help with that part. Call The Belt Law Firm, P.C. at (570) 714-3343 and we will discuss what happened, what you’re feeling now, and how to keep things moving so you can focus on getting better.

On a professional level- Mr Belt was honest, answered all my questions and I knew what to expect. Very knowledgeable about the law. On a personal level- I hadn’t slept the night before the case and I had a bit of anxiety beforehand. Mr. Belt sat in the seating area with me and talked about coffee places. I was cool as a cucumber when it was time to go in. Bottom line is… I’d put all my trust in Mr. Belt and you could too. Also, the women that worked in the front office were always very kind on the phone and in person.

After extensive research, I decided to hire Timothy Belt as my workers’ compensation lawyer based on favorable reviews. Unfortunately, this decision proved to be a serious mistake. I anticipated that he would offer proper guidance and maintain effective communication, which are crucial responsibilities of a lawyer. His deficiency to do so resulted in significant financial strain and emotional distress. Due to his lack of effort and poor performance in my case, the best decision was to terminate his services and seek a new counsel. The difference was extremely noticeable and resulted in a fair outcome.

I just met with Timothy today. (Eric A.) He was very kind, very very knowledgeable about my unique circumstance and I decided to not continue my case in filing an appeal. He had a check in hand for close to a grand, I offered to pay him for his time as it seemed a bad decision to continue my unemployment claim with his knowledge on the subject, although he certainly would have. There were many hurdles, mostly my fault. I would have only ended up with a couple hundred bucks if we won. He was very very clear about that. I offered to pay him for his time today and for emails back and forth, and he just said, we 'll consider this a consultation at no charge. I can't guarantee that to everyone. But he continued to hear my plight after that and said he felt bad for the position I was in. Even gave his thoughts on the matter. Having had to work with many law firms over my years here on earth, I was very impressed with his knowledge and willing to do what he could to help. Thank you Timothy Belt! Much appreciated.

Frequently Asked Questions About Pennsylvania Workers’ Compensation

Report the injury to your employer as soon as possible and obtain any necessary medical treatment.
If the injury is not reported within 120 days, you will lose the right to file for compensation. You cannot legally be fired for reporting a work injury.
The employer reports your injury to their workers’ compensation insurer. If the insurance carrier accepts your claim, they will calculate any compensation owed and make payment. If your claim has not been accepted within 21 days of providing notice of the injury to your employer, your claim is likely denied.
If you receive a notice of denial, you can file a Claim Petition with the Pennsylvania Workers’ Compensation Bureau. Your Petition will be assigned to a Workers’ Compensation Judge. The Judge will schedule hearings, and both sides will be provided the opportunity to present evidence. If the claim is not voluntarily resolved, the judge will issue a Decision.
In most cases you have up to three years from the date of injury to file a Claim Petition.
Any injury or illness that is work-related. It could be a fall, a burn or other workplace incident. It also covers occupational illnesses and repetitive stress injuries that develop over time from toxic exposures or the rigors of the job.

Workers’ compensation insurance covers all medical expenses stemming from your work injury. Workers’ comp pays wage loss benefits until you are able to go back to work. If you suffer an amputation or disfigurement to your face or neck, you may be entitled to additional disability benefits (even if you are still able to work).

Taking a lump-sum settlement may or may not make sense for your situation. You should get legal counsel before agreeing to a settlement.

Workers’ compensation is a complex process. If you fail to follow specific steps and timelines, you risk damaging your claim or not getting the full spectrum of compensation available. Speak with an attorney to ensure your rights are protected.
