Workers’ Compensation for Danville Nurses Injured by Combative Patients

Workers’ Comp for Geisinger Nurses in Danville, PA Injured by Combative Patients

Helping Nurses, Doctors, EMTs, Home Health Aides, and others secure Wilkes-Barre Workers’ Compensation Benefits

Nurses handle difficult situations every day, but when a patient becomes physically aggressive and you end up injured, that changes things. You should not have to work through pain or guess what steps to take next. If you are a Danville nurse who was hurt while trying to care for someone, the injury is work related, and you have the right to start a workers’ compensation claim. The goal is simple. You receive proper medical care, and your pay continues if you cannot safely return to your duties right away by following the workers’ compensation process.

When you contact us, we will take the details of what happened and move the claim forward, so you do not have to deal with back-and-forth conversations or confusing requirements. Our role is to make sure the injury is documented, your treatment is covered, and you are not left to manage this on your own.

If a patient’s behavior led to your injury here in Danville, call The Belt Law Firm, P.C. at (570) 714-3343. Se habla español. Llámenos hoy.”

Common Injuries Geisinger Nurses Suffer When Patients Become Combative

When a patient suddenly becomes aggressive, the way an injury happens is usually quick and messy. Nurses describe moments where they try to steady a confused patient or redirect someone who is agitated, and before they realize it, something snaps or pulls. These are not always dramatic situations. They are fast, physical moments where your body takes the hit, and the effects show up later in the shift or the next morning.

Here are some of the problems we hear about most often from nurses after these incidents:

  • Pain in the shoulder or neck from bracing or trying to stop a patient from striking
  • Sore wrists or fingers after someone grabbed and twisted during an outburst
  • Tightness in the lower back after being pulled or shoved
  • Bruising along the arms or ribs from sudden contact
  • Rolled ankles or sore knees from stumbling while trying to regain control

These workplace injuries make it harder to turn patients, reach overhead, or stay moving for hours at a time. When nurses push through that pain, it often becomes something bigger and harder to treat.

In other cases, nurses are injured in slip, trip, or fall accidents during these incidents, especially when trying to regain control or move quickly in a confined space. Some injuries also happen during patient lifting or transfers that put additional strain on the body.

If a patient hurt you while you were doing your job, the law considers that a work injury. Call The Belt Law Firm, P.C. at (570) 714-3343 and we will walk you through the steps, so your care and income stay protected.

Are Danville Nurses and CNAs Attacked by Patients Eligible for Pennsylvania Workers’ Compensation?

If a patient became aggressive and you were injured, you can file for workers’ compensation in Pennsylvania. The law does not require you to prove the patient meant to hurt you or that you handled the situation perfectly. If the injury happened while you were doing your job, it is considered a work-related injury. We speak with nurses and CNAs who worry that the incident will be questioned or that they should have done something differently. That does not mean you do not have a workers’ compensation claim. You were there to provide care, and you were hurt during providing that care. That is enough for a claim to begin. Many nurses have similar concerns, which we address in our workers’ compensation FAQ.

Once we know what happened, we make sure the injury is reported correctly and your medical treatment and wage benefits move forward without interruption. You should not be left handling paperwork or dealing with an insurance representative while you are still recovering. If you were harmed by a patient while working in Danville, call The Belt Law Firm, P.C. at (570) 714-3343.

Why Nurse Assault Workers’ Comp Claims Often Face Pushback From Insurers

When a nurse is injured by an aggressive patient, the claim should be simple. You were hurt at work, and you need treatment. But insurers sometimes look for gaps or misunderstandings in these incidents, leading to denials and delays even when the injury happened at work. They may question how the injury happened, whether the patient’s behavior was documented immediately, or whether the symptoms appeared later in the shift. None of this means your claim is weak. It means the insurer is trying to limit what they have to pay, even when the facts are clear.

If a claim is denied or stalled, nurses may still have options through workers’ compensation appeals. Our job is to make sure those questions do not become obstacles. We gather the details, organize the report, and speak directly with the insurer so you are not left explaining the same moment over and over.

If your claim is delayed or pushed aside after a patient hurt you on the job, call The Belt Law Firm, P.C. at (570) 714-3343.

On a professional level- Mr Belt was honest, answered all my questions and I knew what to expect. Very knowledgeable about the law. On a personal level- I hadn’t slept the night before the case and I had a bit of anxiety beforehand. Mr. Belt sat in the seating area with me and talked about coffee places. I was cool as a cucumber when it was time to go in. Bottom line is… I’d put all my trust in Mr. Belt and you could too. Also, the women that worked in the front office were always very kind on the phone and in person.

After extensive research, I decided to hire Timothy Belt as my workers’ compensation lawyer based on favorable reviews. Unfortunately, this decision proved to be a serious mistake. I anticipated that he would offer proper guidance and maintain effective communication, which are crucial responsibilities of a lawyer. His deficiency to do so resulted in significant financial strain and emotional distress. Due to his lack of effort and poor performance in my case, the best decision was to terminate his services and seek a new counsel. The difference was extremely noticeable and resulted in a fair outcome.

I just met with Timothy today. (Eric A.) He was very kind, very very knowledgeable about my unique circumstance and I decided to not continue my case in filing an appeal. He had a check in hand for close to a grand, I offered to pay him for his time as it seemed a bad decision to continue my unemployment claim with his knowledge on the subject, although he certainly would have. There were many hurdles, mostly my fault. I would have only ended up with a couple hundred bucks if we won. He was very very clear about that. I offered to pay him for his time today and for emails back and forth, and he just said, we 'll consider this a consultation at no charge. I can't guarantee that to everyone. But he continued to hear my plight after that and said he felt bad for the position I was in. Even gave his thoughts on the matter. Having had to work with many law firms over my years here on earth, I was very impressed with his knowledge and willing to do what he could to help. Thank you Timothy Belt! Much appreciated.

Frequently Asked Questions About Pennsylvania Workers’ Compensation

Report the injury to your employer as soon as possible and obtain any necessary medical treatment.
If the injury is not reported within 120 days, you will lose the right to file for compensation. You cannot legally be fired for reporting a work injury.
The employer reports your injury to their workers’ compensation insurer. If the insurance carrier accepts your claim, they will calculate any compensation owed and make payment. If your claim has not been accepted within 21 days of providing notice of the injury to your employer, your claim is likely denied.
If you receive a notice of denial, you can file a Claim Petition with the Pennsylvania Workers’ Compensation Bureau. Your Petition will be assigned to a Workers’ Compensation Judge. The Judge will schedule hearings, and both sides will be provided the opportunity to present evidence. If the claim is not voluntarily resolved, the judge will issue a Decision.
In most cases you have up to three years from the date of injury to file a Claim Petition.

Workers’ compensation insurance covers all medical expenses stemming from your work injury. Workers’ comp pays wage loss benefits until you are able to go back to work. Taking a lump-sum settlement may or may not make sense for your situation. You should get legal counsel before agreeing to a settlement.

Workers’ compensation is a complex process. If you fail to follow specific steps and timelines, you risk damaging your claim or not getting the full spectrum of compensation available. Speak with an attorney to ensure your rights are protected.
