Clarks Summit Workers’ Compensation Lawyer

Clarks Summit Workers’ Compensation Lawyer

When someone gets hurt at work around Clarks Summit, they usually don’t start by calling a lawyer. They try to shake it off. They take a few days, maybe see the doctor their boss recommends, and assume the system will take care of the rest. But that’s when things often start to fall apart. A missed form. A delayed payment. Suddenly, the checks stop, and no one calls you back.

We’ve spent over 14 years helping workers across Lackawanna County get the benefits they’ve earned. Pennsylvania law gives you 120 days to report your injury and three years to file a claim if you’re not being paid. Those deadlines matter. If you wait too long, the door closes, no matter how real your injury is. We make sure that doesn’t happen. We know the workers’ compensation process, the doctors, and the tactics the insurance companies use to make you give up.

If you’re sitting at home hurt, wondering what to do next, call The Belt Law Firm, P.C. at (570) 714-3343. Se habla español. Llámenos hoy.”

Injuries involving nurses often happen during patient lifting or transfers, which are among the most common hospital-related work injuries we see in Clarks Summit and throughout Lackawanna County.

No matter how it happened, if you were hurt while working, you have rights under Pennsylvania law. These injuries don’t have to involve a dramatic accident to qualify for workers’ compensation benefits, and you shouldn’t be left guessing about what comes next.

Understanding How Clarks Summit Workers’ Compensation Benefits Are Paid

When you get hurt at work, one of the first questions that comes up is how you’ll get paid while you recover and how the workers’ compensation process works. In Pennsylvania, workers’ compensation is meant to replace part of your income and cover medical care, but insurance companies don’t always make it easy. Payments are based on your average weekly wage before the injury, and even small mistakes can affect how much you receive.

We know how frustrating it can be to wait for checks that never come due to denials and delays by the insurance company. You shouldn’t have to chase down the money you’re owed while you’re trying to heal. At The Belt Law Firm, P.C., we’ve helped workers in Clarks Summit, South Abington Township, Waverly, and across Lackawanna County make sure their benefits are calculated and paid the way the law requires.

Many common questions about wage replacement, medical treatment, and return-to-work issues are answered in our workers’ compensation FAQ.

What to Do After an On-the-Job Injury in Clarks Summit or Lackawanna County

The sooner it’s reported, the stronger your claim will be. Make sure it’s written down, even if your supervisor says they’ll “take care of it.” Then get medical attention right away. Your health comes first, and every visit creates a record that supports your claim if questions come up later.

Once the paperwork and medical visits start, things can get confusing fast. Insurance adjusters may call with questions, or you might get a letter saying your claim is under review. That’s when you need someone who understands how this system really works.

At The Belt Law Firm, P.C., we step in to protect your rights, guide you through the next steps, and make sure you’re not pushed back to work before you’re ready. On a professional level- Mr Belt was honest, answered all my questions and I knew what to expect. Very knowledgeable about the law. On a personal level- I hadn’t slept the night before the case and I had a bit of anxiety beforehand. Mr. Belt sat in the seating area with me and talked about coffee places. I was cool as a cucumber when it was time to go in. Bottom line is… I’d put all my trust in Mr. Belt and you could too. Also, the women that worked in the front office were always very kind on the phone and in person.

After extensive research, I decided to hire Timothy Belt as my workers’ compensation lawyer based on favorable reviews. Unfortunately, this decision proved to be a serious mistake. I anticipated that he would offer proper guidance and maintain effective communication, which are crucial responsibilities of a lawyer. His deficiency to do so resulted in significant financial strain and emotional distress. Due to his lack of effort and poor performance in my case, the best decision was to terminate his services and seek a new counsel. The difference was extremely noticeable and resulted in a fair outcome.

I just met with Timothy today. (Eric A.) He was very kind, very very knowledgeable about my unique circumstance and I decided to not continue my case in filing an appeal. He had a check in hand for close to a grand, I offered to pay him for his time as it seemed a bad decision to continue my unemployment claim with his knowledge on the subject, although he certainly would have. There were many hurdles, mostly my fault. I would have only ended up with a couple hundred bucks if we won. He was very very clear about that. I offered to pay him for his time today and for emails back and forth, and he just said, we 'll consider this a consultation at no charge. I can't guarantee that to everyone. But he continued to hear my plight after that and said he felt bad for the position I was in. Even gave his thoughts on the matter. Having had to work with many law firms over my years here on earth, I was very impressed with his knowledge and willing to do what he could to help. Thank you Timothy Belt! Much appreciated.

Frequently Asked Questions About Workers’ Compensation in Clarks Summit, PA

In Laflin, you are required to report your injury to your employer within 120 days of the incident or the date you first realized you were injured. It’s best to report it as soon as possible, as failing to meet this deadline can jeopardize your ability to receive benefits.

Workers’ compensation operates on a no-fault basis, meaning you don’t have to prove that your employer was at fault for your injuries. Similarly, the insurer cannot deny your claim by arguing that you were negligent in causing the injury.

However, there are various aspects of your claim that an insurance company may challenge, such as:

  • The timing of your injury
  • Whether your work contributed to or worsened your injury
  • The type of treatment you need
  • Your average earnings
  • Whether a pre-existing condition is responsible for your condition rather than the injury
  • If you violated your employer’s safety protocols and caused the accident

The benefits you are entitled to depend on these factors. It’s crucial to provide a clear and truthful account of the incident to your workers’ compensation attorney, so they can properly evaluate how the law applies to your case.

Your workers’ compensation claim might be denied for several reasons, including failing to report your injury promptly, submitting the claim after leaving your job, or not following the required procedures. That’s why having legal support can be crucial in ensuring your rights are protected throughout the process.

Common reasons your work injury claim could be rejected include:

  • Delayed injury report: In Pennsylvania, you must inform your employer about your injury within 120 days. Failing to do so could result in your claim being denied, as the workers’ compensation system requires timely reporting.
  • Discrepancy between the accident report and medical records: If the details in the accident report differ from the medical findings, it may raise questions. For example, if you report a leg injury from a fall but later discover a concussion that wasn’t mentioned in the report, the insurance company might view this as inconsistent.
  • Filing after termination or layoff: If you file a claim after losing your job, the insurance company might consider it suspicious, potentially leading to an immediate denial.
  • Lack of witnesses: If no one saw the accident happen, your employer might argue that the injury didn’t occur while you were at work, complicating your claim.
  • Failure to cooperate: Not engaging with the claims process, such as refusing to sign necessary documents or provide requested statements, can hurt your case.

If your workers’ compensation claim has been denied, don’t hesitate to seek legal guidance. Contact The Belt Law Firm, P.C., at (570) 714-3343, and get your free case review today!

If you receive a notice of denial, you can file a Claim Petition with the Pennsylvania Workers’ Compensation Bureau. Your Petition will be assigned to a Workers’ Compensation Judge. The Judge will schedule hearings, and both sides will be provided the opportunity to present evidence. If the claim is not voluntarily resolved, the judge will issue a Decision.

In most cases you have up to three years from the date of injury to file a Claim Petition.

Any injury or illness that is work-related. It could be a fall, a burn or other workplace incident. It also covers occupational illnesses and repetitive stress injuries that develop over time from toxic exposures or the rigors of the job.

Workers’ compensation insurance covers all medical expenses stemming from your work injury. Workers’ comp pays wage loss benefits until you are able to go back to work. If you suffer an amputation or disfigurement to your face or neck, you may be entitled to additional disability benefits (even if you are still able to work).

Taking a lump-sum settlement may or may not make sense for your situation. You should get legal counsel before agreeing to a settlement.

Workers’ compensation is a complex process. If you fail to follow specific steps and timelines, you risk damaging your claim or not getting the full spectrum of compensation available. Speak with an attorney to ensure your rights are protected.

There is no upfront or out-of-pocket cost to you. We provide a free initial consultation. You do not pay any legal fees unless and until we recover benefits for you.
